Rule 107
Arrangements relating to carbon services
(1) In order to participate in the carbon trading according to the Act and the current Environmental Protection Act, the Ministry through any agency under the Ministry may create and implement a program to increase carbon reserves and reduce emissions within the forest area of Nepalambara.
(2) During the preparation and implementation of the program according to sub-rule (1), the conservation and sustainable management of the existing natural forest and biological diversity and ecological system, the social of the local community; It should be ensured that there is no adverse effect on economic and cultural rights, traditional and customary knowledge and practice and the use of the latest knowledge.
(3) The program under sub-rule (1) will be implemented by the Ministry through any agency under the Ministry with the participation of the Provincial Ministry, Directorate, Division Forest Office, consumer groups, related local communities and local levels.
(4) The amount of carbon storage and emission reduction increased in the forest sector through the implementation of the program as per sub-rule (1) may be sold by the Government of Nepal for a certain period of time through the process of internationally accepted carbon trading.
(5) In accordance with sub-rule (4), the ministry may send a concept letter to the carbon buyer and proceed with the initial stage of carbon trading within the forest area.
(6) According to sub-rule (4), prior informed consent of the affected local communities shall be obtained by informing the forest user groups and other affected local communities by following the procedure determined by the Government of Nepal before selling carbon services.
(7) The unit price of the increase in carbon reserves and reduction of emissions during the implementation of the program under sub-rule (1) shall be as per the agreement between the Government of Nepal and the buyer country or international organization of the carbon service.
(8) According to this rule, at least eighty percent of the profit amount obtained from carbon trading shall be deposited in the fund through the Ministry of Finance.
(9) Carbon Service BapIn order to distribute the amount received in the fund, the Ministry is subject to rule 115 and prepares a plan for the distribution of benefits with the participation of the local level, related private forest owners, forest user groups and affected local communities in the areas where the program according to sub-rule (1) is implemented. It should be distributed among the levels, consumer groups, local communities and private forest owners.
